These Terms of Service ("Terms") govern your access to and use of the Where Am I? mobile application and related services (the "Service"), provided by Inertia Lab, LLC ("Inertia Lab," "we," "us," or "our"). By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Please also review our Privacy Policy, which explains how we collect and use your information and is incorporated into these Terms by reference.
Account means the unique account you create to access the Service.
Application or App means Where Am I?, the software program provided by Inertia Lab.
Content means any photos, text, location guesses, comments, usernames, and other material posted, uploaded, or shared through the Service.
Company (referred to as "we," "us," or "our") refers to Inertia Lab, LLC, 1154 Meredith Way, Folsom, CA 95630.
Service refers to the Application and all features, content, and functionality made available through it.
You means the individual accessing or using the Service, or the entity on whose behalf such individual is acting.
You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you meet this requirement and that all registration information you submit is accurate and current. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.
You may sign in using third-party authentication providers, including Sign in with Apple and Google. Your use of those sign-in methods is also subject to the respective provider's terms.
Where Am I? is a social photo-based location-guessing game. Users post photographs and other users attempt to identify the location depicted by selecting from a set of options, which may include answer choices generated with the assistance of artificial intelligence. Scores, streaks, and other game mechanics are provided for entertainment purposes only and have no monetary value.
We may modify, suspend, or discontinue any part of the Service at any time, including game mechanics, scoring, and features, without liability to you.
You retain ownership of the Content you create and post. However, by posting Content to the Service, you grant Inertia Lab a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, display, adapt, distribute, and otherwise use that Content for the purpose of operating, providing, promoting, and improving the Service.
You represent and warrant that you own or have the necessary rights to the Content you post, that the Content does not infringe the rights of any third party, and that you have the consent of any identifiable individuals depicted. You are solely responsible for the Content you post and the consequences of posting it.
There is zero tolerance for objectionable content or abusive behavior on the Service. You agree that you will not post Content or engage in conduct that:
is unlawful, harassing, threatening, abusive, hateful, defamatory, or harmful;
is sexually explicit, pornographic, or depicts nudity, or sexualizes minors in any way;
depicts or promotes violence, self-harm, or illegal activity;
infringes any patent, trademark, copyright, privacy, publicity, or other right of any party;
reveals private or personally identifying information about another person without their consent;
is false, misleading, or intended to deceive other users about a location or identity;
contains software viruses, malware, or any code designed to disrupt or impair the Service;
impersonates any person or entity, or misrepresents your affiliation with a person or entity; or
attempts to gain unauthorized access to the Service, other accounts, or our systems.
We reserve the right, but are not obligated, to review, monitor, and remove Content at our sole discretion, and to suspend or terminate accounts that violate these Terms.
The Service provides tools to report objectionable Content and to block abusive users. We review reports of objectionable Content and will act on them, which may include removing Content and ejecting the user who provided it, generally within 24 hours. Content uploaded to the Service is screened using automated systems before it becomes visible to other users. If you encounter Content or conduct that violates these Terms, please use the in-app reporting tools or contact us at privacy@inertialab.ai.
The Service, including its software, design, text, graphics, logos, and all related intellectual property (excluding User Content), is owned by Inertia Lab and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use, subject to these Terms. You may not copy, modify, reverse-engineer, distribute, or create derivative works of the Service except as permitted by law.
The following additional terms apply to your use of the Application obtained through the Apple App Store ("App Store Sourced Application"). To the extent the other terms of these Terms are less restrictive than, or otherwise conflict with, the terms of this section, the more restrictive or conflicting terms of this section will apply, but solely with respect to the App Store Sourced Application.
Acknowledgement. You acknowledge and agree that these Terms are concluded between you and Inertia Lab only, and not with Apple, Inc. ("Apple"). Inertia Lab, not Apple, is solely responsible for the App Store Sourced Application and its content. These Terms do not provide usage rules for the Application that conflict with the Apple Media Services Terms and Conditions.
Scope of License. The license granted to you for the App Store Sourced Application is limited to a non-transferable license to use the Application on any Apple-branded product that you own or control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that the Application may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.
Maintenance and Support. Inertia Lab is solely responsible for providing any maintenance and support services with respect to the Application, as specified in these Terms or as required under applicable law. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Application.
Warranty. Inertia Lab is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be Inertia Lab's sole responsibility.
Product Claims. Inertia Lab, not Apple, is responsible for addressing any claims by you or any third party relating to the Application or your possession and/or use of the Application, including but not limited to: (i) product liability claims; (ii) any claim that the Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
Intellectual Property Rights. In the event of any third-party claim that the Application or your possession and use of the Application infringes that third party's intellectual property rights, Inertia Lab, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
Legal Compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
Developer Name and Address. Inertia Lab, LLC, 1154 Meredith Way, Folsom, CA 95630. Any questions, complaints, or claims regarding the Application should be directed to privacy@inertialab.ai.
Third Party Terms of Agreement. You must comply with applicable third-party terms of agreement when using the Application.
Third Party Beneficiary. You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including if you violate these Terms. You may stop using the Service and delete your account at any time. Upon termination, the licenses you granted for previously posted Content may persist to the extent necessary for the operation, backup, or legal compliance of the Service, and provisions of these Terms that by their nature should survive termination will survive.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that location data, AI-generated options, or other information presented through the Service will be accurate or reliable. Any data or information displayed through the Service is for general informational and entertainment purposes only.
To the maximum extent permitted by applicable law, in no event will Inertia Lab be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of or inability to use the Service. To the maximum extent permitted by law, our total aggregate liability for any claims arising out of or relating to these Terms or the Service will not exceed the greater of the amount you paid us, if any, to use the Service in the twelve months preceding the claim, or one hundred U.S. dollars ($100).
You agree to indemnify and hold harmless Inertia Lab and its officers, members, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your Content, your use of the Service, or your violation of these Terms.
These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in California to resolve any dispute arising out of these Terms or the Service.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date above, and where appropriate, by providing notice through the Service. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
